By browsing our Site, placing an order, creating an account, or otherwise engaging with our brand, you acknowledge that you have read, understood, and agree to be bound by these Terms in full. If you do not agree with any part of this Agreement, please discontinue use of our Site and services immediately.

Bluebird Pads is a small, independent, family-operated business dedicated to creating sustainable, handmade, eco-friendly period products using organic cotton, low-impact dyes, and ethical production practices. All products are crafted with care in Courtenay, BC, Canada. We are committed to transparency, environmental stewardship, body positivity, and providing accessible, high-quality menstrual care solutions. These Terms reflect our values while establishing clear expectations for a respectful, safe, and mutually beneficial relationship with our customers.
2. Eligibility and Account Responsibility
To access or use the Bluebird Pads Site, you must be at least the age of majority in your province or territory of residence (or 18 years of age, whichever is higher), or have the express permission of a parent or legal guardian who agrees to be bound by these Terms on your behalf. All products are subject to availability. We reserve the right to limit quantities, discontinue items, or modify product offerings at any time without prior notice. If an item you order is unexpectedly out of stock, we will contact you promptly to offer a replacement, backorder option, or full refund.
Our reusable period products are designed for personal hygiene use. We provide detailed care instructions with every order to ensure optimal performance and longevity. Proper use and maintenance are the responsibility of the purchaser. Bluebird Pads is not liable for issues arising from misuse, improper care, or use contrary to the provided guidelines.

4. Pricing, Payment, and Tax Information
All prices displayed on the Bluebird Pads Site are in Canadian Dollars (CAD) and are subject to change without notice. We make every effort to ensure pricing accuracy, but in the rare event of an error, we reserve the right to cancel or correct orders placed at incorrect prices.
As required by Canadian law, all menstrual products sold in Canada, including reusable cloth pads, period underwear, liners, and associated accessories such as wet bags, are exempt from the Goods and Services Tax (GST), Harmonized Sales Tax (HST), and Provincial Sales Tax (PST). This exemption, commonly referred to as the "Tampon Tax" repeal, recognizes period products as essential health items. You will not be charged sales tax on eligible items at checkout.
We accept the following payment methods: Visa, Mastercard, Shop Pay, and PayPal. All transactions are processed through secure, PCI-compliant payment gateways. We do not store full credit card information on our servers. By completing a purchase, you authorize us to charge your selected payment method for the total order amount, including applicable shipping fees.
Orders are processed within two (2) business days of payment confirmation, excluding weekends and Canadian statutory holidays. During peak sales periods or holidays, processing times may extend slightly. You will receive an email confirmation once your order has
been placed and again when it has shipped.
5. Shipping, Delivery, and Risk of Loss
Shipping terms, options, costs, and estimated delivery timelines are detailed in our separate Shipping Policy, which is incorporated into these Terms by reference. Please review it carefully before placing an order.
Title and risk of loss for products pass to you upon delivery to the carrier. While we take great care in packaging and selecting reliable shipping partners, we cannot control delays, loss, or damage that may occur during transit. For tracked shipments, we will assist in filing carrier claims if packages are lost or damaged. For untracked Lettermail shipments within Canada, we cannot verify delivery or guarantee replacement for lost items, though we may offer courtesy resolutions on a case-by-case basis.
You are responsible for providing a complete, accurate, and deliverable shipping address. Bluebird Pads is not liable for orders delivered to incorrect addresses provided by the customer. If a package is returned to us due to address errors, additional fees may apply for reshipment.
6. Returns, Exchanges, and Refunds
Our approach to returns, exchanges, and refunds is guided by our commitment to sustainability, hygiene, and customer satisfaction. Full details are outlined in our Return & Refund Policy, which is incorporated into these Terms by reference.
In summary:
- We accept returns or exchanges for verified structural defects or workmanship issues reported within 30 days of delivery
- All returned items must be gently washed, air-dried, and in resalable condition (unless defective)
- Due to hygiene considerations, we cannot accept returns on used, washed, or worn items for reasons of change of mind or fit preference after use
- Fading, staining, or general wear and tear from normal use are not considered defects
- Refunds, when approved, are issued to the original payment method within 5–7 business days and exclude original shipping costs unless the return resulted from our error
By purchasing from Bluebird Pads, you acknowledge and agree to these return conditions.
7. Intellectual Property Rights
All content featured on the Bluebird Pads Site, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, product designs, patterns, and software, is the exclusive property of Bluebird Pads or its content suppliers and is protected by Canadian and international copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from our Site without our express written permission. This includes product photographs, pattern designs, brand assets, and written materials. Personal, non-commercial use of our content (such as sharing a product photo on social media with credit) is welcomed and encouraged, provided it aligns with our brand values and does not misrepresent our products or business.
8. User Conduct and Prohibited Activities
By using the Bluebird Pads Site, you agree
not to:

11. Indemnification
You agree to defend, indemnify, and hold harmless Bluebird Pads, its owners, employees, contractors, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms
- Your use of the Site, including any use of content, services, or products other than as expressly authorized
- Your violation of any third-party right, including intellectual property, privacy, or publicity rights
- Any dispute between you and a third party related to your use of our Site or products

- Follow all provided care instructions, including washing in cold/warm water with mild detergent, avoiding bleach and fabric softeners, and air-drying when possible
- Inspect products regularly for signs of wear, seam integrity, or snap functionality
- Discontinue use if you experience irritation, discomfort, or notice product degradation
- Store clean, dry products in a breathable container or reusable wet bag
Bluebird Pads products are not medical devices and are not intended to diagnose, treat, cure, or prevent any health condition. If you have concerns about menstrual health, please consult a qualified healthcare professional. By using our products, you acknowledge that you are responsible for your own health and hygiene practices.
14. Governing Law and Dispute Resolution
These Terms and your use of the Bluebird Pads Site shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof shall be subject to the exclusive jurisdiction of the courts located in Courtenay, British Columbia, Canada. By using our Site, you consent to personal jurisdiction in these courts and waive any objection to venue or forum non convenient.
